Dear Congressman Posey
I am writing you to address a problem with an amendment (2007-027) to Indian River County Code 911.11. It changed the zoning use table of permitted uses. Community opportunities for manufacturing paper, chemical, brick and tile, glass, cement and concrete and non-metallic materials were just some of the industry removed from the permitted use in light industrial land. Some of this land is in the FEC industrial rail corridor. The moving of these manufacturing opportunities places a burden on safety as some of these uses are only able to develop along the rail because the process involved requires moving of hazardous materials over the rail instead of road. This Text change created a situation that needs correcting for job growth, property rights, public safety and concurrency of the State comprehensive plan. It appears that no consideration was given to the scope, intent, or merit. The notice to the public does not explain the far reaching effects of these changes to the permitted uses of industrial property owner rights in you district as there were 31 use changes to the table. This very amendment violates state statutes; state and federal constitutional rights, and creates inconsistencies with the state objectives for industry. If there is anything you can do to help solve this dilemma. I have contacted the county but was not given help because of the pending law suit over the amendment being used to stop the Ocean Concrete proposed batch plant. ! It seems someone needs to fix this before someone else files suit. I believe industry creates jobs and workers buy homes, and it is the communities of people with jobs that support commercial.
